McDaniel was driving with a blood alcohol level of 0.14 percent, when he lost control and crashed through the gates of the prison, he got out of the car which was still in gear and it crashed into a tree.  When a correctional officer tried to restrain him, he punched the sergeant in the face  and broke the officer's nose.&lt;br /&gt;&lt;br /&gt;McDaniel pleaded guilty to one felony count of aggravated assault on an officer, one felony count of an ex-convict entering grounds of a correctional facility, one misdemeanor count of reckless driving, and one misdemeanor count of driving under the influence of alcohol and, one misdemeanor count of driving with a blood level of .08 percent or more. Had Lohan not recalled the bench warrant out for her arrest, she could have been detained and/or arrested upon landing and coming through customs.  "If Los Angeles County says, 'Yes, the warrant is active, and yes, we would like to extradite,' then we would turn over a subject to the local police department who would coordinate with the agency that issued the warrant," according to Customs and Border Protection spokesman John Saleh.  Lindsay will still have to appear in court on Monday for Judge Revel to set the formal terms of her release.  A formal probation violation hearing date will also need to be set for Judge Revel will determine whether or not, Lindsay Lohan was in violation of her probation. Lohan’s attorney Shawn Chapman Holley told the judge the actress's passport was stolen at the Cannes Film Festival this week. "She filed a police report. She intended to fly back at the earliest possible time. I don't know what else to tell you. She had reservations for a flight," she added.  Judge Revel countered, "There is no valid excuse for Lohan not being here.” "If she wanted to be here, she could've been here. She could've come two days early from Cannes. She has a history of not keeping scheduled appointments. She has to take this seriously. I've warned her before."  The Judge also ordered that if Lohan posts bail she is to abstain from alcohol, be fitted with a SCRAM (Secure Continuous Remote Alcohol Monitor) bracelet, and be subject to random drug testing once a week.  A probation violation hearing date is pending Lohan's return to court, Judge Revel said Lohan may be in violation of her probation because she previously ordered the actress to attend the class at least "once a week without fail.”  An arrest warrant was previously issued against Lindsay Lohan, on March 13, 2009. The responding deputies took a police report but permitted Waters to leave the scene. &lt;br /&gt;&lt;br /&gt;Waters was involved in a second accident when he crashed his Mercedes-Benz into a Toyota, a 78-year-old passenger in the Toyota, suffered minor injuries according to the California Highway Patrol.&lt;br /&gt;&lt;br /&gt;CHP officers, who responded to the second accident said Waters showed signs of being intoxicated and was booked on suspicion of driving under the influence. Waters is a 13-year veteran of the Orange County Sheriff’s Department, assigned to south Orange County, according to the Sheriff’s Department. The jury had acquitted the 28-year-old defendant of attempted murder. According to the Daily Breeze a car driven by a Manhattan Beach police officer collided with two other vehicles.  The driver fled the scene, abandoning his vehicle at an Arco gas station, when Manhattan Beach police officers were called to investigate they learned that the driver was a fellow Manhattan Beach police officer, no arrests were made and a police report was not taken. The city owned Chrysler 300M sustained major front end damage and the tires on the vehicle’s left side were destroyed.  Leach drove another three miles before being pulled over by a Riverside police patrol unit.  A six-page collision report filed by the police officers who conducted the traffic stop indicated that Leach had been drinking.  Leach has also admitted that prescription medication that he was taking contributed to the accident.   According to California Highway Patrol Inland Division Chief Jeff Talbot, "Chief Leach was driving on Central Avenue and allowed his car to drift off the road," "I understand that two of the tires were down to the rim."   The CHP is investigating the incident, but Talbot said it was too early in the investigation to determine the cause of the accident or whether alcohol was involved.  Talbot said Riverside Police Deputy Chief John De La Rosa contacted him Tuesday and asked the CHP to investigate the accident.   "He thought it would be in the best interests of everyone for us to do it," Talbot said. "They wanted us to come in because we are completely unbiased."  The CHP will often handle criminal investigations when they involve officers from other law enforcement agencies.   Ironically Leach spoke out against drunk driving saying, "Designating a sober driver should be on the top of everyone's Super Bowl party list," "It's just one of several easy steps to help save lives."  According to the Riverside City Manager’s Office Leach, 61, was retiring for medical reasons, effective immediately. Sobriety checkpoints in California are becoming increasingly profitable for police departments, an investigation by the Investigative Reporting Program at UC Berkeley with California Watch found that impounds at checkpoints in 2009 generated an estimated $40 million in towing fees and police fines.  In addition, police officers received about $30 million in overtime pay for the DUI crackdowns, which are funded by the California Office of Traffic Safety.  The Investigative Reporting Program also found that officers impounded more than 24,000 vehicles at checkpoints with only 3,200 drunken driving arrests.  Last year, the LAPD on average assigned 35 police officers to each checkpoint and averaged 6 DUI arrests and impounded 20 to 30 vehicles.  Most of the roadblocks over the past two years occurred in or near Hispanic neighborhoods, the Investigative Reporting Program’s analysis shows. He would plead not guilty by reason of insanity.  He has been charged with 13 counts of premeditated murder. The proposition required collection of DNA samples from all felons, and from adults and juveniles arrested for or charged with specified crimes, and submission to state DNA database; and; in five years, from adults arrested for or charged with any felony.  The proposition required that beginning on Jan. 1, 2009, authorities must take a sample from any adult who is arrested for a felony, regardless of whether that person is ever charged or convicted of a crime.  According to Jill Spriggs, the chief of California's Bureau of Forensic Services there are more than 1.3 million DNA samples in its database.  This is the largest library of DNA samples of any state, the third largest in the world behind the United States and the United Kingdom, and it is growing at a rate of 25,000-30,000 samples per month, according to Jill Spriggs, the database turns up roughly 300 genetic matches per month.&lt;br /&gt;&lt;br /&gt;Since the passage of Proposition 69 thousands of samples have been taken from people, some of whom have never been charged with a crime.  One of these people was Elizabeth Haskell, who was arrested during an anti-war rally in San Francisco. Suspected of aiding another protester escape from police custody, she was herself taken into custody and given a choice, she could either provide a DNA sample, or spend more time in custody.  She provided the sample, in the end however no charges where ever filed.  Haskell and another individual have filed suit in federal court and are being represented in the suit by the American Civil Liberties Union. If a probationer is lawfully detained by police while operating a motor vehicle and has a measurable amount of alcohol in their system, then their driver’s license can be suspended for one year, their vehicle can be impounded, and this is in addition to a possible violation of probation.  &lt;br /&gt;&lt;br /&gt;California Vehicle Code Section 23154 states:&lt;br /&gt;(a) It is unlawful for a person who is on probation for a violation of Section 23152 or 23153 to operate a motor vehicle at any time with a blood-alcohol concentration of 0.01 percent or greater, as measured by a preliminary alcohol screening test or other chemical test. &lt;br /&gt;(b) A person may be found to be in violation of subdivision (a) if the person was, at the time of driving, on probation for a violation of Section 23152 or 23153, and the trier of fact finds that the person had consumed an alcoholic beverage and was driving a vehicle with a blood-alcohol concentration of 0.01 percent or greater, as measured by a preliminary alcohol screening test or other chemical test. (&lt;br /&gt;c) (1) A person who is on probation for a violation of Section 23152 or 23153 who drives a motor vehicle is deemed to have given his or her consent to a preliminary alcohol screening test or other chemical test for the purpose of determining the presence of alcohol in the person, if lawfully detained for an alleged violation of subdivision (a). &lt;br /&gt;(2) The testing shall be incidental to a lawful detention and administered at the direction of a peace officer having reasonable cause to believe the person is driving a motor vehicle in violation of subdivision (a). &lt;br /&gt;(3) The person shall be told that his or her failure to submit to, or the failure to complete, a preliminary alcohol screening test or other chemical test as requested will result in the suspension or revocation of the person's privilege to operate a motor vehicle for a period of one year to three years, as provided in Section 13353.1. &lt;br /&gt;&lt;br /&gt;Once cited for a violation of Vehicle Code section 23154 you have only 10 days to request a hearing or your license will automatically be suspended for one year. &lt;br /&gt;If you are accused of driving under the influence of alcohol, it is imperative that you have an experienced criminal defense attorney, like the attorneys at the Law Offices of David M. He will now have to sit in jail awaiting trial. This brings up an issue how the criminal law system deals with mentally ill people. Like so many other state services, the budget cuts are affecting the court system. Some changes you should be aware of are:&lt;br /&gt;&lt;br /&gt;(1) Calif. courts to close 1 day a month to save money: The California Supreme Court along with every appellate and trial court in the state, will close the third Wednesday of every month from September 2009 through July 2010 (Los Angeles County Courts started closing one day a week in mid-July). When a person is arrested for a crime, he must by law be brought to court within set periods of time to be permitted to ask for a bail reduction and to plead to the charges. This will mean that many people accused of crimes will have to sit in jail an additional day to wait to come to court.&lt;br /&gt;&lt;br /&gt;(2) The Judicial Council increased the fees many litigants have to pay when appearing in court&lt;br /&gt;&lt;br /&gt;(3) One of the most controversial proposals in the most recent state budget was the early release of 27,000 inmates from California prisons. The prison cuts were delayed until later this year when, presumably, the hype of the state budget agreement is over and a discussion on inmate release won't be so contentious.&lt;br /&gt;&lt;br /&gt;(4) California cuts of Prop. 36 drug treatment funding: Proposition 36, approved by 61 percent of voters in November 2000, enacted the Substance Abuse and Crime Prevention Act effective July 1, 2001. It requires that first- or second-time nonviolent adult drug offenders who use, possess or transport illegal drugs be sent to treatment rather than jail; eligible offenders can get up to a year of drug treatment and six months of aftercare. Offenders found not amenable to treatment can be punished with jail time.&lt;br /&gt;&lt;br /&gt;The Legislature and Gov. Arnold Schwarzenegger have agreed to cut Proposition 36 funding, but the underlying sentencing law remains. The courts are still obligated to push the people into treatment, knowing that the funds, the programs, the services aren't there.&lt;br /&gt;&lt;br /&gt;Under the budget fixes Schwarzenegger signed into law Tuesday, Proposition 36 funding drops to just $18 million, an 83 percent cut. Even if the state manages to transfer into the program up to $45 million in federal stimulus money — a figure advocates believe to be pie-in-the-sky — that still would amount to a 42 percent reduction from last year's level.&lt;br /&gt;&lt;br /&gt;If you’re a client of The Law Offices of David M. I’m David M. Wallin, a Criminal Defense attorney working in Southern California. I graduated from Long Beach State University with a B.S. Degree in Criminology/Administration of Justice. After obtaining that degree, I attended the University of West Los Angeles School of Law, located at the time in Culver City, California. I happened to live in Culver City so it was perfect for me.&lt;br /&gt;&lt;br /&gt;Upon graduating from Law School, I interviewed with the Los Angeles County District Attorney's Office. Within a matter of weeks I was hired and was a Deputy District Attorney, a job I held for about 5 years. In that time I handled thousands of cases as well as participating in an excess of 100 Jury Trials. I worked a variety of assignments from Juvenile Law to all aspects of Adult Prosecution.&lt;br /&gt;&lt;br /&gt;Upon leaving the DA's office I began work for another criminal defense firm. In the years I worked there I handled hundreds of cases and defended many people at jury trials.&lt;br /&gt;&lt;br /&gt;After leaving that firm, I began my own firm. I started the firm with just myself and one paralegal. I began with a simple idea - Work hard for your clients; always speak truthfully to your clients and charge a fair rate.&lt;br /&gt;&lt;br /&gt;Too many attorneys out there will either promise clients whatever they want to hear or scare them into believing the case is worse than it is. I vow never to play those games. At our office we will always let our clients know what they're facing and the plan to try to assist them to maximize their chances of either a dismissal of the charges or a reduction of the charges.&lt;br /&gt;&lt;br /&gt;Now it's been almost 18 years that I've practiced nothing but criminal law. I'm sure I've handled or participated in an excess of 100,000 cases by now. I have also been honored with certification as a Criminal Law Specialist in the state of California.&lt;br /&gt;Since I first started by own firm, it’s grown into the largest Criminal Defense Firm in the High Desert and Northern Los Angeles County area. Two expertly trained lawyers plus 6 highly proficient paralegals have joined the team.
